The Federal Court has recently released its long-awaited decision in Energizer Brands, LLC v Gillette Company, 2023 FC 804. We invite you to join Charlotte McDonald and James Green as they discuss this ruling and the related prior cases from the Federal Court and Federal Court of Appeal. This presentation will focus on how this case affects comparative advertising in Canada, touching upon the Court's comments on s. 7(a), 7(d), and 22(1) from the Trademarks Act as well as s. 52(1) of the Competition Act. Charlotte and James will also explore the Court's comments on the expert evidence that was filed.
Charlotte McDonald is a partner in the Intellectual Property group at Gowling WLG. Charlotte’s practice focuses on intellectual property litigation, including trademark and patent litigation, as well as trademark prosecution. She has had extensive experience before the Federal Court and Trademarks Opposition Board. Charlotte is also a registered trademark agent. Charlotte is an active member of the Intellectual Property Law section of the CBA and currently serves on the executive committee.
James Green is a partner in the Intellectual Property Group at Gowling WLG. James represents clients in trademark, patent, design, and copyright litigation before all levels of court in Canada, proceedings before the Trademarks Opposition Board, and in domain name disputes. James is a registered trademark and patent agent and regularly provides advice to clients with respect to strategy, clearance, and enforcement. James regularly writes and speaks on intellectual property issues, including recent guest lectures on trademark topics at Osgoode Hall Law School.
