Many applicants seek due care reinstatement, but few are chosen. Early experiences with CIPO's "due care" regime have been frustrating: opaque guidance and high standards, and a process that moves at a glacial pace. What can agents do to help their clients salvage their applications and patents?

Please join us as Jenna Wilson discusses the following:

  • How unintended abandonments and expiries happen; and
  • Dissecting CIPO's analytical process:
    • Why due care submissions fail, and what can be done about it.
    • How CIPO's "due care" standard matches up with the Code of Professional Conduct and professional negligence.
The presentation is eligible for up to one hour of substantive CPD. 

Jenna Wilson has more than 20 years of experience in intellectual property law with a focus on patent drafting and prosecution. Her patent prosecution work emphasizes emerging technologies and subject areas that challenge the boundaries of current patent law, such as biotechnology and information technology. As a registered patent agent, she has drafted patent applications and procured patent rights for clients across a wide range of fields ranging from medicine to oil & gas to financial technology. Widely regarded as a thought leader and renowned for her in-depth knowledge of Canadian patent law, Jenna was the 2021 recipient of the Intellectual Property Institute of Canada (IPIC) Outstanding Contribution Award for her significant contributions to the intellectual property community.
