Financial Remedies in IP Disputes

Like this session (the last of TIPG’s annual slate before the summer hiatus), financial remedies are often left for the end of IP disputes. 

Ephraim Stulberg’s presentation will provide a brief overview of the general principles governing financial remedies in IP disputes (damages, profits, reasonable royalties, prejudgment interest), and discuss how these principles have been applied in recent cases. He will conclude the presentation with a discussion of some key unresolved issues.

Ephraim Stulberg is a Partner in MDD Forensic Accountants’ Toronto office where he is one of the leaders of the firm’s litigation services practice. He has provided expert witness testimony in court and at arbitration. He has been involved in numerous assignments involving quantification of financial remedies due to intellectual property infringement, as well as many other types of disputes. He has published various articles on the topic of financial remedies in IP disputes, and was named by the Canadian Institute of Chartered Business Valuators as its “Communicator of the Year” for 2018.
